Acceptance

By downloading or using Duskward, you agree to these Terms of Use. If you do not agree, please do not use the app.

License

Duskward is licensed, not sold. Jake Haas grants you a personal, non-exclusive, non-transferable, revocable license to use Duskward on devices that you own or control: on Apple-branded devices subject to the Usage Rules set out in the Apple Media Services Terms and Conditions, and on Android devices consistent with the Google Play Terms of Service.

Acceptable use

Please do not copy, resell, rent, sublicense, reverse-engineer, decompile, or attempt to extract the source code of Duskward, except to the extent these restrictions are prohibited by applicable law.

Purchases

Any purchase — Duskward itself or features within it — is handled by the store you downloaded from: Apple through the App Store, or Google through Google Play. That company processes the payment under its own policies, including its billing and refund terms; I never receive your payment details.

Advertising

Duskward is free and supported by ads served through Google AdMob. I do not choose, endorse, or control the individual ads you are shown, and any dealings you have with an advertiser are between you and them. What the ad network collects is described in the Privacy Policy.

Disclaimer of warranties

Duskward is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. I do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that it will meet your requirements.

Limitation of liability

To the fullest extent permitted by law, Jake Haas will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising out of or relating to your use of Duskward.

Apple and the App Store

These Terms are between you and Jake Haas only, and not with Apple. Apple is not responsible for Duskward or its content.

Apple has no obligation to provide any maintenance or support for Duskward. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app; if the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. Apple is not responsible for addressing any claims relating to Duskward, including product-liability, regulatory, or intellectual-property claims.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you. You also represent that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Google and Google Play

These Terms are between you and Jake Haas only, and not with Google. Google is not responsible for Duskward or its content and has no obligation to provide maintenance or support for it.

Your download of Duskward from Google Play is also subject to the Google Play Terms of Service, and purchases made through Google Play are covered by Google Play's refund policies.

Changes to these terms

I may update these Terms from time to time. The date above shows the most recent change, and continued use of Duskward after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules.
